J. Pyland Interview (#6749), dated July 16, 1937: 2 CONT Mr. Pyland was born in Greene County, Arkansas, May 3 1865. He 2 CONT owns a little store about seven miles east of Talihina and six miles 2 CONT west of Whitesboro, on what is now called Upper Road. This road is 2 CONT one of three roads leading from Talihina to Whitesboro. 2 CONT He quotes: "I am of Irish descent. I came to the Indian 2 CONT Territory in 1887, which was fifty years ago. My occupation was 2 CONT hunting and trapping fur bearing animals. The first night that I 2 CONT spent in what is now called Oklahoma was at the old Council House at 2 CONT Tuskahoma. It was a wonderful sight as there was a trial of some kind 2 CONT going on. I suppose there were three or four hundred Indians there, 2 CONT and I never saw so much barbecued beef and goat in my whole life. The 2 CONT Indians were very friendly to me, and offered me any amount of meat 2 CONT that I wanted. The sheriff would not allow me to go in to court. I 2 CONT am not sure who the Governor was but I think it was McCurtain. 2 CONT There was just one road leading through the valley then, and that 2 CONT was the Arkansas to Strington road. 2 CONT Some of the Indians' homes were built of logs, but the most of 2 CONT them were built by driving four posts in the ground and putting a 2 CONT brush top on. 2 CONT I remember one time I was trying to find a man by the name of 2 CONT Kennedy. I rode up to a house, and asked a boy who was about eighteen 2 CONT years old, where he lived. He wouldn't say anything, but only shook 2 CONT his head when I asked. It made me very angry but there wasn't 2 CONT anything I could do about it. As I was leaving I took a chew of 2 CONT tobacco and offered him a chew. He seemed pleased about the tobacco, 2 CONT and then he walked five miles and showed me where Mr. Kennedy lived 2 CONT without saying a word. It was the hardest thing in the world to get 2 CONT information of any kind. As a rule when you rode up to the house the 2 CONT Indians would go out the back door, and you would hardly ever find the 2 CONT man of the house at home. He was usually hunting or fishing. 2 CONT The Indians were very queer about their food. I came to an 2 CONT Indian camp on the bank of the Kiamichi River late one afternoon. As 2 CONT I sat around waiting for the man folks to come in, I noticed some of 2 CONT the women kept digging something out of the fire and covering it up 2 CONT again. I decided to find out what it was. It was these Terrapins of 2 CONT which we see so many in the summer time. They said that they were 2 CONT fine to eat, after they were toasted." 2 CONT 1900 census notes 5 children, 3 living. 2 CONT Jake did not move permanently to OK until 1900 and built his 2 CONT country store six miles east of Talihina, LeFlore County, OK. Rt. #LA - Porter 2 CONT Nickens - written to Uncle Billy Pyland on the occasion of his 100th 2 CONT birthday celebration. 2 CONT Dear Mr. Pyland, I know that you will be surprised to hear from me, an 2 CONT utter stranger, but the fact is this, that after having read and 2 CONT enjoyed an account of your 100th birthday celebration I wanted to make 2 CONT bold and write and congratulate you upon having attained your 100th 2 CONT birthday. I hope that you may have many more. There are several 2 CONT reasons why I am writing you, not because I am related to the Pyland 2 CONT family by blood, but only by marriage. My only brother married Flora 2 CONT Bell Pyland, daughter of the late Warren Pyland who died here 80 years 2 CONT ago next month. Warren Pyland's father was Hardy Pyland and today I 2 CONT have talked with Miss Etta Hill, one of our oldest residents. She 2 CONT thinks Mr. Hardy's father (was) a brother of your father or 2 CONT grandfather. Another reason for writing, I live 3 miles N.E. of 2 CONT Farmington and my place joins the old Bluford Pyland farm. What I 2 CONT know of Bluford Pyland was told me by the widow of Rev. Robert Freeman 2 CONT who lived on the old Bluford Pyland farm from 1875 up into the early 2 CONT 20's of this century. She told me that Bluford lived where her garden 2 CONT then was, in a big cedar two story house. He was a batchelor (sic) and 2 CONT usually had some family living in the house with him. About the time 2 CONT of the Civil War he and the man and his wife that was then living with 2 CONT him were over across the branch, on a slight rise picking cotton in a 2 CONT field of a few acres. Someone happened to look up and saw that the 2 CONT house was in flames. When they got there it was too late to save much 2 CONT of the furniture and in the rush all of them forgot Mr. Pyland's 2 CONT money, of which he was reputed to have a nice sum, which was most 2 CONT likely buried under the house, as succeeding events proved. After this 2 CONT Mr. Pyland erected or at least started another log house of one story, 2 CONT a bit out in front of where (the) other had burned. I think he died 2 CONT before it was finished, and Rev. and Mrs. Freeman from Bedford County 2 CONT bought the place and moved there and added more to the house. They 2 CONT made their garden where the house had burned, and for many years 2 CONT afterwards when (their) garden was being plowed small silver coins 2 CONT would be plowed up. Some of them being half dimes. Some were in 2 CONT (good) condition. Some of them I have seen. Mrs. Freeman died about 2 CONT 1923 and the farm was sold for division. The man who bought the place 2 CONT tore the log house away and built one out closer to the road. The 2 CONT garden spot is where your Uncle Bluford's house burned. I was a kid 2 CONT when Mrs. Freeman told me these things, pretty much interested and 2 CONT wish I had listened more closely. Miss Hill tells me that her parents 2 CONT lived there in the house with Mr. Bluford one year soon after they 2 CONT were married. I was just wondering if this could not be where you 2 CONT were born also? Getting back to Warren Pyland, he was twice married. 2 CONT First to a Noblin, then to a Cleek. He had four children, Willie 2 CONT deceased, Flora, my sister-in-law, Minnie and Mai. He had two 2 CONT brothers, Jim Matt and Newton, who moved over Petersburg way, and 2 CONT changed the spelling of their names to Pylant. There are a lot of 2 CONT folks over in the Petersburg community who are named Pylant, but they 2 CONT are just plain old Pylands. Mr. Warren's mother was an O'Neal. Mr. 2 CONT Warren had several sisters, one of whom married a Rankin. I can 2 CONT remember Mr. Warren quite well. My brother and sister-in-law live 2 CONT here near me. Mr. Hardy Pyland and his wife, also Mr. Warren and his 2 CONT (wife) lies here buried in the old Mt. Lebanon church cemetery. His 2 CONT last wife is still living. I also knew Mr. Budd Pyland but what his 2 CONT given name was, I do not know. I think he was a first cousin to Mr. 2 CONT Warren. He lived to be past 80, having died about 7 years or so ago. 2 CONT I am surprised at your family being Methodist, not that there is 2 CONT anything wrong with being a Methodist since my parents were Methodist, 2 CONT and I used to be but rather because all of the Pylands that I ever 2 CONT knew were Missionary Baptists. Here in our neighborhood sometime away 2 CONT before 1830 a Primitive Baptist church was erected close to the 2 CONT present Mt. Lebanon cemetery. The name of this church has long been 2 CONT lost to the memory of man. About 1834 a dispute came up in this 2 CONT church regarding missions and the church was bursted (sic) up. There 2 CONT were two O'Neal brothers who were members of this church. One stayed 2 CONT with the Primitive Baptist and the other went with the Missionary 2 CONT church. One of the brothers gave a tract of land up the road about 2 CONT two miles and the primitive Baptist erected a big log church which 2 CONT they called New Zion which stood there until 22 years ago and it grew 2 CONT so weatherbeaten that long before my day people called it Old Zion or 2 CONT the Old Baptist. The other O'Neal brother gave a lot a few hundred 2 CONT yards across the creek from the old Mt. Lebanon cemetery, and on this 2 CONT in 1844 was erected a big log church dedicated as Mt. Lebanon 2 CONT Missionary Baptist church. This stood until in 1885 (when) a nice 2 CONT large frame church was erected just back of the old log church site. 2 CONT This stood in its turn until Sunday morning Feb 26, 1950 when it 2 CONT caught (fire) from the flue and burned just after we had gotten home 2 CONT from Sunday School. A nice new church (frame) stands on the ground 2 CONT where the other burned and we have it completed except for sanding the 2 CONT floors and building the porch in front and maybe a cupola or steeple. 2 CONT Outsiders sent donations as far away as Mayfield, Kans. and so far we 2 CONT do not owe a cent on the building. It has a membership of 176 and we 2 CONT are mostly poor folks. Awhile ago I spoke of one of Mr. Warren 2 CONT Pyland's sisters having married a Rankin. Her name was Molly, and she 2 CONT has a daughter by (the) name of Mrs. Nannie Powell, or Mrs. Zeek 2 CONT Powell living close by. Mrs. Powell is about 80 and one of the most 2 CONT active and lovable old ladies that I ever saw. She still takes an 2 CONT avid interest in all current affairs such as the Korean war, keeps up 2 CONT with the radio and newspapers, and still does her own housework. She 2 CONT perhaps knows more about the Pyland family when it comes to away back 2 CONT than any other living person. If you cared to write to her I am quite 2 CONT sure she would be delighted to hear from you, and if you are as 2 CONT interested in your ancestors as I am, I am sure you would enjoy 2 CONT hearing from Mrs. Powell. I don't suppose you remember anything about 2 CONT Tenn. as it seems you were so young when you left here, nor do I 2 CONT suppose to take either of our Marshall County papers, so since an 2 CONT account of your celebration appeared in both county papers I am 2 CONT sending you one account, and keeping the other for my scrap book. Beard with a band of 2 CONT Tories attacked there. Also in the house were Mr. Drake, his son 2 CONT Albritton, about 17 years old, Benjamin Bridgers, his half brother, 2 CONT Nathaniel Nichols, and Henry Massenger, and "old Mrs. Drake", who was 2 CONT in another room. Albritton Drake was one of a corps of light horse and 2 CONT had been on active duty scouring the country for these very men. He 2 CONT ran outside and fired at them. The house was then surrounded by the 2 CONT Tories and they ordered the men inside to surrender. Old Mr. Drake, 2 CONT gun in hand, advanced on the enemy. Beard was the leader and he and 2 CONT his men rushed the house. Albritton Drake swung his cutlass, but hit 2 CONT the joist above his head and broke his sword at the hilt. Old Mr. 2 CONT Drake began clubbing the Tories with his gun but Beard's sword struck 2 CONT him down. Old Mrs. Drake entered the room with a "jug of old Nash" and 2 CONT she kept the brandy flowing until all was peaceful again. This had 2 CONT been fairly easy because Beard had been a suitor for her daughter's 2 CONT hand in marriage. Finally Capt. Peter Goodwin and his light horse 2 CONT troops rode up and made an attack on the Tories who beat a hasty 2 CONT retreat. Benjamin Bridgers and Beard struggled. Headright 2 CONT claims for 43 persons, including Richard Piland (Pyland), were made on 2 CONT 20 Nov 1683 by Peter Wycke and John Leneare (Lanier). The Headright 2 CONT system was a successful plan used to populate the colony. Every 2 CONT shareholder/stockholder in the Virginia Company who transported an 2 CONT emigrant, whether free or bond, to the Colony, could claim fifty acres 2 CONT as Headright if the emigrant remained in Virginia for a period of 2 CONT three years. The person claiming this Headright was expected to 2 CONT furnish each one he transported with a small tract of land and the 2 CONT necessities of life. The indentured servant signed a contract that 2 CONT specified the terms of this servitude. He also relinquished his right 2 CONT to the free grant of 50 acres of land that was offered to those who 2 CONT would immigrate to the colonies. This land was given to the persons 2 CONT who paid their passage and who claimed them as indentured servants. 2 CONT After the terms of the agreement were up he could then become free to 2 CONT acquire his own land. Robert Pitt, Major John Bond, Capt. English, Mr. James Pyland. 2 CONT The first representative legislative body in America was the House of 2 CONT Burgesses. It was the first in any English colony. Jamestown was the 2 CONT capital of Virginia and they first met on 30 Jul 1619. Two citizens 2 CONT (Burgesses) from each burrough/subdivision of VA attended the 2 CONT sessions. The House was given the authority to make all legislation 2 CONT (1621), but the governor and his council had the right of veto. 2 CONT English law was used in the House and they followed the English 2 CONT Parliament procedures. The House claimed the right to act on all tax 2 CONT laws. The House of Burgesses impeached Gov. Her house had 52 layers where it was 2 CONC papered with newspapers, even the ceiling. 2 CONT 2 CONT In the late 1920's and 30's during the spring months and during the 2 CONC hot weather, babies would catch colitis very easily. Doctors couldn't 2 CONC cure colitis. Mary discovered that she could take wood ditney (found 2 CONC near hickory), strip the leaves off and make a tea. When given to the 2 CONC sick babies, it would likely save them. She sent Hershel Kincade and 2 CONC Waive Todd for roots. She would hang them in the smokehouse and let 2 CONC them dry, then strip and boil them. She saved Tom Kincade, Ed and 2 CONC Myrl's son. 2 CONT 2 CONT She liked to sit by the fire place and chew tobacco. 2 CONT 2 CONT She never owned a home until after Grandpa Kincade died. Then she 2 CONC bought the old Sutton Home or it was deeded to her. 2 CONT 2 CONT When Mary Kincade turned 60 she "gave up housekeeping", sold her house 2 CONC to Ed Kincade, and started living about three months at a time with 2 CONC her grown children. She kept her feather bed and brought it with her 2 CONC each time she changed homes. 2 CONT 2 CONT 2 CONT 2 CONT Mary's obituary reads: Mrs. Mary Elizabeth Kincade, aged 84, lifetime 2 CONC resident of Pocahontas, died at the home of her daughter, Mrs. Earl 2 CONC Dawson, March 15. She was born March 18, 1863, a daughter of the late 2 CONC Mr. and Mrs. Frank Sutton. Her husband, John Kincade, preceded her in 2 CONC death several years ago. She was a member of the Free Will Baptist 2 CONC Church. 2 CONT 2 CONT Funeral services were conducted at Sutton church Sunday at 2:30 p.m., 2 CONC by the Revs. Ralph Staten and W. He was the oldest of six sons and six daughters born to the 2 CONC marriage of Forester Sutton and Mary McNiece. He lived in Marshall 2 CONC County, TN, where he married Ann Noblin, until 1852, at which time he 2 CONC settled in Southwest Missouri. He settled in Randolph County, 2 CONC Arkansas three years later and this is where he made his home. The 2 CONC community in which he settled his large family was named after him - 2 CONC the Sutton Community. 2 CONT 2 CONT "Frank" joined the Confederate forces in 1861, becoming a member of 2 CONC Company H, Colonel Shaver's regiment of infantry. When he returned 2 CONC from his duties, he returned to the duties of farm life. Politically 2 CONC he was a Republican. 2 CONT 2 CONT Family members have different stories about Frank. Most agree that he 2 CONC was on furlough from his duties and did not ever return to his 2 CONC infantry during the Civil War. Everett Lee Sutton says that he was 2 CONC told as a small child that when the soldiers came to Frank's house to 2 CONC see if he was home, that he would go into a trap door in the floor of 2 CONC the cabin. Ann would pull a braided rug over the door and put her 2 CONC rocker over it and sit there when the soldiers would come to the door. 2 CONC When they asked her where her old man was, she would tell them that 2 CONC "he's where Dick's dollar is". Louise Kincade Jansen was told a 2 CONC similar story, 2 CONT that he lived in the old homeplace, grandpa Sutton dug a hole and made 2 CONC a trap door. When the soldiers came to the house, he would climb into 2 CONC the trap door, go out the back of the house, and hide in the woods 2 CONC until they left. He was sure that if they found him that he would be 2 CONC killed for desertion. Sutton taken by defendants at the office of 2 CONC James McCollum, Clerk and Master, in Pulaski, Tennessee on the sixth 2 CONC of October 1849 in presence of parties and counsel to be used in the 2 CONC above case now depending in Chancery at Pulaski, Tennessee. The said 2 CONC witness being first duly sworn forth. 2 CONT 2 CONT That he is acquainted with the parties to this suit. He is also 2 CONC acquainted with the land in controversy. That in the year 1847 2 CONC somewhere between July and September at the Barren Spring (spelled 2 CONC Barn Spring in other documents) on Pigeon Roost, I heard a 2 CONC conversation between James McNeese, Andrew J., and Isaac McNeese in 2 CONC which the said Andrew J. and James said that Isaac A. had paid them up 2 CONC for the land and have over (meaning overpaid). Then said Andrew J. 2 CONC and James said they would not pay Isaac A. McNeese anything back 2 CONC because he had got the land cheap enough without their doing so. The 2 CONC conversation was in reference to the fifty acre tract of land in 2 CONC dispute. I had before on several occasions heard them say they had 2 CONC sold the land to Isaac A. McNeese. I had before the conversation at 2 CONC the Barren Spring heard James and Isaac A. say the latter had let 2 CONC James McNeese have fifty dollars to buy him a hatterŽs kettle (?) and 2 CONC this at the Barren Spring was admitted by both to have been toward the 2 CONC payment of the land. 2 CONT 2 CONT I know that William Hall took the benefit of the Bankrupt Law and 2 CONC before he did so he placed in the possession of Isaac A. McNeese a 2 CONC horse to indemnify him as his (HallŽs) security in a debt to Jo 2 CONC McMillion. After he had given up the horse to Isaac A. he applied to 2 CONC him to get him again per the ground he had no horse to make a crop. 2 CONC Isaac A. lent him the horse to make the crop and was to have him back 2 CONC when he called for him. Hall refused to let him have him. And 2 CONC Thompson, Isaac took the horse away from him and Hall Thompson had a 2 CONC warrant issued against Isaac A. for horse stealing. 2 CONT 2 CONT I am a nephew of said Andrew J., James, and Isaac A. McNeese. My 2 CONC mother was their sister. 2 CONT 2 CONT Cross examination - I shall be 22 years old eighteenth day of February 2 CONC next. I now live in Marshall County, Tennessee. I have lived there 2 CONC 12 or 15 years and it is about 26 miles from where the said Andrew J., 2 CONC James, and Isaac A. lived. I lived in Giles before I moved to 2 CONC Marshall. My mother is dead. I was in the habit of visiting my 2 CONC relations in Giles some two, three, four times, and sometimes more a 2 CONC year and was in Giles some three or four times in 1847. I heard 2 CONC awhile after their father died that there had been some trading as to 2 CONC the land in dispute between complainants and Isaac A. I am unable to 2 CONC say how long their father has been dead but would suppose some seven 2 CONC or eight years. I canŽt say that there was anybody present at the 2 CONC conversations at the Barren Springs or the other conversation given in 2 CONC this deposition except complainants, Isaac A., and myself. All the 2 CONC conversations I heard were either at the hatterŽs shop or the Barren 2 CONC Spring. There was no one living at the Barren Spring at the time. The 2 CONC parties had no pen, ink, or paper at the Spring. They made 2 CONC calculations in their heads and totaled (?) accordingly. None of them 2 CONC could write. They sat awhile and stood awhile. It was in the 2 CONC evening. The land in dispute is fifty acres and lies on the bridge. 2 CONT 2 CONT I canŽt say I am unfriendly to complainants at this time. When my 2 CONC deposition was not being taken in Marshall County sometime before 2 CONC this, James McNeese jumped on Isaac A. McNeese and I struck James with 2 CONC a stick. Before then I was generally friendly with all of them. I 2 CONC hit him with the stick but most of the lick was knocked off by then 2 CONC (or other). He had me arrested and it cost me $5.00 on the next 2 CONC morning. The Barren Spring is in sight of the old residence where 2 CONC their mother lived and was fine water where people passing generally 2 CONC stopped to get water. Sutton, the subject of this sketch, was born in the state of 2 CONC Missouri on Jan 15, 1856, and came to Arkansas with his parents when 2 CONC but a small boy and has spent the greater part of his life in Randolph 2 CONC County. He was married to Miss Tishie Million in August, 1877, and to 2 CONC this union twelve children were born, five of whom preceded their 2 CONC father to the spirit world. 2 CONT 2 CONT Brother Sutton suffered for several months with a complication of 2 CONC diseases and passed to his eternal reward at 10:30 o'clock p.m., July 2 CONC 19. He leaves a wife and seven children, namely: G.F., Will, and 2 CONC Wiley, who live near their father; Mrs. Burly Vandergriff of Keifer, 2 CONC Oklahoma; Mrs. Dora Pitzenberger of Tulsa Oklahoma, and Miss Pear and 2 CONC Bennie, who are yet at home. All the children were with their father, 2 CONC when death came, except Mrs. Vandergriff. 2 CONT 2 CONT The deceased was 50 years, 6 months and 4 days old. He was a 2 CONC consistent christian gentleman, a member of the Church of God and 2 CONC loved and respected by all. He bore his affliction without a murmur 2 CONC and trusted fully in God. His re ains were followed to the Sutton 2 CONC cemetery by a large concourse of friends and relatives, on July 20, 2 CONC where they were laid to rest to await the final summons at the last 2 CONC great day. Funeral services were conducted by the writer. 2 CONT 2 CONT Weep not, dear friends, for he is free from all sorrow and pain.
